A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §18B-10-1d, relating to establishing the West Virginia Andrew J. Trail Purple Heart Recipient College Bill of Rights Act of 2007; and allowing certain disabled recipients of the purple heart to attend a state college or university without paying tuition or fees for eight semesters.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended, by adding thereto a new section, designated §18B-10-1d, to read as follows:
ARTICLE 10. FEES AND OTHER MONEY COLLECTED AT STATE INSTITUTIONS OF HIGHER EDUCATION.
§18B-10-1d. The West Virginia Andrew J. Trail Purple Heart Recipient College Bill of Rights Act of 2007.

(a) This section is named and shall be known as the West Virginia Andrew J. Trail Purple Heart Recipient College Bill of Rights Act of 2007.
(b) Effective the first day of July, two thousand seven, every resident of this state who has been honorably discharged from any branch of the United States Military services and has been awarded the purple heart shall, upon proof thereof, be exempt from the payment of any additional tuition and fees over and above any federal education benefits provided to the purple heart veteran at any state college, university or community college in which he or she is enrolled for not more than eight semesters: Provided, That any person meeting the requirements of this subsection who is either permanently disabled or has lost a limb resulting from combat wounds occurring while serving in the military services of this country shall, upon proof thereof, be exempt from the payment of any tuition and fees at any state college, university or community college regardless of any other federal benefits received.
(c) Upon the exhaustion of the eight semesters of reduced or free tuition attendance, the full tuition shall be paid by any recipient of the provisions of this section for any additional semesters attended.

The West Virginia Andrew J. Trail Purple Heart Recipient College Bill of Rights Act of 2007 and to provide that certain permanently disabled recipients of the purple heart may attend state colleges and university for eight semesters without paying tuition or fees.
