A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new article, designated §31-21-1 and
§31-21-2, all relating to the creation of the Good Coal
Company Neighbor Act; and requiring coal companies that have
mining operations in a county to provide coal, at the
prevailing wholesale rate, to residents of that county.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new article, designated §31-21-1 and §31-21-2,
all to read as follows:
ARTICLE 21. COAL COMPANIES.
§31-21-1. Short title.
This article may be cited as the "Good Coal Company Neighbor
Act."
§31-21-2. Coal companies to provide coal to county residents.
Coal companies that have coal mining activities in a county of
this state must provide easy access to coal, for home heating
purposes, to residents of that county:
Provided, That the company
may charge no more than the prevailing wholesale rate for the coal.
NOTE: The purpose of this bill is to
require coal companies
that have coal mining operations in a county to provide coal, at
the prevailing wholesale rate, to residents of that county.
§31-21-1 and §31-21-2 are new; therefore, strike-throughs and
underscoring have been omitted.
