A BILL expiring funds to the unappropriated surplus balance in the
State Fund, General Revenue, for the fiscal year ending June
30, 2010, in the amount of $29,000,000 from the Lottery
Commission - Video Lottery Income Fund, fund 7203, fiscal year
2010, organization 0705, and making a supplementary
appropriation of public moneys out of the Treasury from the
balance of moneys remaining as an unappropriated surplus
balance in the State Fund, General Revenue, to the Governor's
Office, fund 0101, fiscal year 2010, organization 0100, to the
Department of Revenue - State Budget Office, fund 0595, fiscal
year 2010, organization 0703, and to the Bureau of Senior
Services, fund 0420, fiscal year 2010, organization 0508, by
supplementing and amending the appropriations for the fiscal
year ending June 30, 2010.
WHEREAS, The Legislature finds that the account balance in the
Lottery Commission - Video Lottery Income Fund, fund 7203, fiscal year 2010, organization 0765, exceeds that which is necessary for
the purposes for which the account was established; and
WHEREAS, The Governor submitted to the Legislature a statement
of the State Fund, General Revenue, dated August 10, 2009, setting
forth therein the cash balance as of July 1, 2009; and further
included the estimate of revenues for the fiscal year 2010, less
net appropriation balances forwarded and regular appropriations for
the fiscal year 2010; and
WHEREAS, It appears from the Governor's statement of the State
Fund, General Revenue, and this legislation there now remains an
unappropriated surplus balance in the State Treasury which is
available for appropriation during the fiscal year ending June 30,
2010; therefore
Be it enacted by the Legislature of West Virginia:
That the balance of the funds available for expenditure in the
fiscal year ending June 30, 2010, to the Lottery Commission - Video
Lottery Income Fund, fund 7203, fiscal year 2011, organization
0705, be decreased by expiring the amount of $29,000,000 to the
unappropriated surplus balance of the State Fund, General Revenue,
to be available for appropriation during the fiscal year 2010.
And that the total appropriation for the fiscal year ending
June 30, 2010, to fund 0101, fiscal year 2010, organization 0100,
be supplemented and amended by increasing an existing item of
appropriation as follows:

The above appropriation for One-time Salary Enhancement - Surplus, activity ___, shall be allocated by the State Budget
Office in accordance with W.Va. Code §5-5-7.
And that the total appropriation for the fiscal year ending
June 30, 2010, to fund 0420, fiscal year 2010, organization 0508,
be supplemented and amended to read as follows:

Any unexpended balance remaining in the appropriation for
Unclassified - Total - Surplus (fund 0420, activity 284) at the
close of the fiscal year 2009 is hereby reappropriated for
expenditure during the fiscal year 2010.
The above appropriation for Transfer to Division of Human
Services for Health Care and Title XIX Waiver for Senior Citizens
along with the federal moneys generated thereby shall be used for
reimbursement for services provided under the program. Further,
the program shall be preserved within the aggregate of these funds.
The purpose of this bill is to expire funds into the unappropriated surplus balance in the State Fund, General Revenue,
and to supplement, amend, add and increase items of appropriation
in the aforesaid accounts for the designated spending units for
expenditure during the fiscal year 2010.
