A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §25-1-4, relating
to limitation on reimbursement rate to medical service
providers for services outside Division of Corrections'
facilities.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §25-1-4, to read as
follows:
ARTICLE 1. ORGANIZATION, INSTITUTIONS AND CORRECTIONS
MANAGEMENT.
§25-1-4. Limitation on reimbursement rate to medical service
providers for services outside division facilities.
Effective the first day of July, two thousand six, the
Division of Corrections and its contracted medical provider may not pay to an outside provider of a medical service for a person
residing in a correctional or detention facility an amount
greater than the reimbursement rate applicable to that provider
and that service as established by rule of the Department of
Health and Human Resources Medicaid Program. This limitation
applies to all medical care services, goods, prescription drugs
and medications provided to a person who is in the custody of a
correctional or detention facility and is provided these services
outside of the correctional or detention facility.
NOTE: The purpose of this bill is to limit the amount the
Division of Corrections and its
contracted medical provider
s may
pay for medical care administered to inmates outside of
correctional or detention facilities to the rates allowed under
the Medicaid Program.
