HOUSE JOINT RESOLUTION NO. 17

Proposing an amendment to the Constitution of the State of West
Virginia, amending article VI thereof by adding thereto a new
section, designated section 57, relating to dedicating one
percent of general revenue to the Division of Natural
Resources to be used to fund activities intended to promote
and preserve the state's wildlife resources and to fund
law-enforcement activities involving the Division of Natural
Resources; numbering and designating such proposed amendment;
and providing a summarized statement of the purpose of such
proposed amendment.
Resolved by the Legislature of West Virginia, two thirds of
the members elected to each house agreeing thereto:
That the question of ratification or rejection of an amendment
to the Constitution of the State of West Virginia be submitted to
the voters of the State at the next general election to be held in
the year 2006, which proposed amendment is that article VI be
amended by adding thereto a new section, designated section 57, to read as follows:
ARTICLE VI. THE LEGISLATURE.
§57. One percent of general revenue fund dedicated to Division of
Natural Resources.
The Legislature, each fiscal year, shall dedicate in
appropriation one percent of all funds existing in the general
revenue fund to the Division of Natural Resources. The Division
shall use the funds to promote and preserve fish and wildlife
conservation and nongame wildlife resources, and to fund
law-enforcement activities of the Division.
Resolved further, That in accordance with the provisions of
article 11, chapter 3 of the Code of West Virginia, 1931, as
amended, such proposed amendment is hereby numbered "Amendment No.
1" and designated as the "Dedication of Funding to Natural
Resources Amendment" and the purpose of the proposed amendment is
summarized as follows: "To dedicate each fiscal year one percent
of the total funds existing in the State's general revenue fund to
the Division of Natural Resources to be used to promote and
preserve the State's natural resources and to fund law-enforcement
activities associated with natural resources."
NOTE: The purpose of this resolution is to provide
constitutionally that the Legislature appropriate one percent of
the state's general revenue fund to the Division of Natural
Resources each fiscal year to be used to promote and preserve the
state's natural resources and to fund law-enforcement activities
associated with the Department of Natural Resources.
