HOUSE CONCURRENT RESOLUTION NO. 56

Requesting the Joint Committee on Government and Finance to study
the creation of a West Virginia Sentencing Commission.
Whereas, There is a need for fair and uniform sentencing; and
Whereas, There is a need to consider alternatives to
incarceration for nonviolent offenders; and
Whereas, There is a need to utilized the limited correction
resources in a manner to best serve and protect the public;
therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to study the creation of a West Virginia Sentencing
Commission; and, be it
Further Resolved, That the Joint Committee on Government and
Finance, seek input from the Governor's Committee on Crime and
Delinquency, the West Virginia Supreme Court of Appeals and a group
of judges; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report the Legislature on the first day of the regular session, 2010, on its findings, conclusions and recommendations
together with drafts of any legislation to effectuate its
recommendations; and, be it
Further Resolved,That the expenses necessary to conduct
this study, prepare a report and the drafting of necessary
legislation be paid from legislative appropriations to the Joint
Committee on Government and Finance.
