A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §17C-3-11, relating to the adoption of rules for traffic control signals; requiring the Commissioner of Highways to propose a rule for adopting the permissive yellow rule for yellow traffic control signals; and requiring the Commissioner of Highways to base any proposed rules on traffic control signals on the Federal Highway Administration’s “Manual on Uniform Traffic Control Devices”.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §17C-3-11, to read as follows:
ARTICLE 3. TRAFFIC SIGNS, SIGNALS AND MARKINGS.
§17C-3-11. Standards for traffic control signal.
(a) Notwithstanding any provisions of this code to the contrary, with respect to yellow traffic control signals, the Commissioner of Highways shall propose legislative rules for adopting a “permissive yellow rule,” meaning:
(1) A driver can legally enter an intersection during entire yellow interval; and
(2) A violation occurs if driver has not cleared intersection after onset of red.
(b) Notwithstanding any provisions of this code to the contrary, with respect to all traffic control signals, the Commissioner of Highways shall propose legislative rules in adherence with the traffic control signal specifications set forth in most recent edition of the Federal Highway Administration’s “Manual on Uniform Traffic Control Devices.”
NOTE: The purpose of this bill is to require the Commissioner of Highways to propose legislative rules in adherence with the Federal Highway Administration’s Manual on Uniform Traffic Control Devices when proposing rules on traffic control signals.
