A BILL to amend and reenact §30-1-4a of the Code of West Virginia, 1931, as amended, relating to the appointment of citizen members to professional licensing boards.

Be it enacted by the Legislature of West Virginia:

    That §30-1-4a of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:

ARTICLE 1. GENERAL PROVISIONS APPLICABLE TO ALL STATE BOARDS OF EXAMINATION OR REGISTRATION REFERRED TO IN CHAPTER.

§30-1-4a. Lay Citizen members of professional boards.

    (a) If a board referred to in this article does not have a citizen member, then the Governor shall appoint at least one citizen member to represent the interests of the public on the board.

    (b) If the total number of board members on a board after the appointment of one citizen member is an even number, then one additional citizen member shall be appointed. Citizen members serve in addition to any other board members otherwise provided by law.

    © Appointment terms for citizen members:

    (1) If the addition of a citizen member results in an odd number of board members, then the term for the citizen member shall be for the number of years of a complete term of a board member; or

    (2) If the addition of a citizen member results in an even number of board members and an additional citizen member is appointed, then the term for the first citizen member appointed shall be for the number of years of a complete term of a board member, and the term for the second citizen member appointed shall be for one year less than the number of years of a complete term of a board member.

    (d) A citizen member may not serve more than two consecutive full terms.

    (e) Citizen members shall be:

    (1) At least eighteen years of age;

    (2) Of good moral character; and

    (3) Competent to represent and safeguard the interests of the public.

    (f) Each citizen member is authorized to participate in and vote on all the business of the board.

    NOTE: The purpose of this bill is to provide for the appointment of citizen members to professional licensing boards.
