A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §7-20-12a, relating
to prohibiting counties from using service fees or user fees
to finance infrastructure projects.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §7-20-12a, to read as
follows:
ARTICLE 20. FEES AND EXPENDITURES FOR COUNTY DEVELOPMENT.
§7-20-12a. User fees or service fees prohibited from financing
infrastructure projects.
Notwithstanding any provision of this code to the contrary,
the county commission may not use service fees or user fees, as set
forth in section twelve of this article, to finance infrastructure
projects.
NOTE: The purpose of this bill is to prohibit counties from
using service fees or user fees to finance infrastructure projects.
