AN ACT to amend and reenact §16-21-1 of the Code of West Virginia, 1931, as amended, relating to donating blood by persons sixteen years of age with parental consent.

Be it enacted by the Legislature of West Virginia:
That §16-21-1 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:
ARTICLE 21. BLOOD DONATIONS.

§16-21-1. Donations by seventeen year old minors without parental permission.

Notwithstanding any other provision of law to the contrary, any person seventeen years of age or older may donate blood without the permission or authorization of a parent or guardian and any person sixteen years of age may donate blood
with the permission or authorization of a parent or legal guardian: Provided, That a parent or guardian may not be liable for any medical expense which may occur as a result of a minor donating blood under the provisions of this section: Provided, however, That nothing herein may be construed as permitting a minor of age seventeen or older, or a minor of age sixteen, to give blood for compensation in any form.
