[Introduced March 19, 2013; referred to the

A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §19-2B-13, relating to poultry inspection exemptions.

Be it enacted by the Legislature of West Virginia:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §19-2B-13, to read as follows:

ARTICLE 2B. INSPECTION OF MEAT AND POULTRY.

§19-2B-13. Inspection of poultry raised, slaughtered by producer on own farm.

In accordance with reasonable rules promulgated by the commissioner, regulations regarding inspections of facilities may not apply to any poultry producer with respect to poultry which is raised and slaughtered by the producer on his or her own farm, so long as the producer slaughters not more than 3,000 poultry during the calendar year for which the exemption is being determined, and the producer does not buy or sell poultry products other than those produced from poultry raised on his or her own farm.

NOTE: The purpose of this bill is to increase the number of poultry which can be slaughtered and sold under Department of Agriculture relaxed inspection regulations from 1,000 to 3,000 birds which are raised and slaughtered by the producer on his or her own farm.

This section is new; therefore, it has been completely underscored.
