A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §4-1-24, relating to
making it a crime to interfere with a member of the
Legislature while engaged in the performance of his or her
official duties; and providing for misdemeanor penalties.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §4-1-24, to read as
follows:
ARTICLE 1. OFFICERS, MEMBERS AND EMPLOYEES; APPROPRIATIONS;
INVESTIGATIONS; DISPLAY OF FLAGS; RECORDS; USE OF
CAPITOL BUILDING; PREFILING OF BILLS AND
RESOLUTIONS; STANDING COMMITTEES; INTERIM MEETINGS;
NEXT MEETING OF THE SENATE; INTERFERENCE OF MEMBERS;
CRIMINAL PENALTIES.
§4-1-24. Interference of members; criminal penalties.
(a) No person may impede, intimidate or interfere with a
member of the Legislature who is engaged in the performance of his
or her official duties or on account of such performance.
__(b) Any person who violates subsection (a) of this section is
guilty of a misdemeanor and, upon conviction thereof, shall be
fined not more than $500 or confined in jail for not more than
thirty days, or both fined and confined.
NOTE: The purpose of this bill is to
make it a crime to
interfere with a member of the Legislature while engaged in the
performance of his or her official duties. The bill also provides
for misdemeanor penalties.
