A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §19-16-10, relating
to
prohibiting any body other than the Legislature from
regulating seed registration, sale, labeling, storage,
transportation, distribution, notification of use or use.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §19-16-10, to read as
follows:
ARTICLE 16. WEST VIRGINIA SEED LAW.
§19-16-10. Statewide uniform seed regulation.
Statewide jurisdiction and preemption. - - This chapter and
its provisions are of statewide concern and occupy the whole field
of regulation regarding the registration, labeling, sale, storage, transportation, distribution, notification of use, and use of seeds
to the exclusion of all local regulations. Except as otherwise
specifically provided in this article, no ordinance or regulation
of any political subdivision or home rule municipality may prohibit
or in any way attempt to regulate any matter relating to the
registration, labeling, sale, storage, transportation,
distribution, notification of use or use of seeds, if any of these
ordinances, laws or rules are in conflict with this chapter.
NOTE:
The purpose of this bill is to
prohibit any body other
than the Legislature from regulating seed registration, sale,
labeling, storage, transportation, distribution, notification of
use or use.
