A BILL to amend the code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §5A-4-2a, relating to
creating the "Friends of the Capitol Foundation" for the
express purpose of exploring and finding ways to obtain
funding for maintenance of the state capitol building and its
grounds.
Be it enacted by the Legislature of West Virginia:
That the code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §5A-4-2a, to read as
follows:
ARTICLE 4. GENERAL SERVICES DIVISION.
§5A-4-2a. Friends of capitol foundation; creation; composition;
purpose;
terms of members; vacancies; duties.
(a) There is hereby created a "Friends of the Capitol
Foundation," hereinafter referred to as the foundation, which is
composed of six members who are appointed by the governor, with the advice and consent of the Senate. The secretary of the department
of administration shall also serve as a consultant to the
foundation. No more than three members may be of the same
political party. The foundation shall exist as a nonprofit entity
whose primary purpose is to raise money for the maintenance of the
state capitol building and grounds.
(b) Members shall be appointed for terms of four years and may
be reappointed at the expiration of their terms. In the event of
a vacancy, an appointment shall be made to fill the unexpired term.
(c) The foundation shall organize by electing a chairman, a
vice chairman and a secretary from among its members. The members
of the foundation shall serve without compensation and shall be
reimbursed for necessary travel expenses, subsistence and other
reasonable expenses as may be actually incurred by them in the
performance of their duties, all to be paid by the joint committee
on government and finance.
(d) The foundation shall study, recommend and implement ways
to obtain funding through donations, grants, loans, and user fees,
if legislatively authorized, for the maintenance of the state
capitol building and its grounds. The secretary of the department
of administration shall propose rules for legislative approval in
accordance with the provisions of chapter twenty-nine-a of this
code, designed to implement the provisions of this article.
NOTE: The purpose of this bill is to create the "Friends of
the Capitol Foundation" for the express purpose of exploring and
finding ways to obtain funding for maintenance of the state capitol
building and its grounds.
