A BILL to amend the code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §5A-8-22, relating to
nondisclosure of personal information maintained by the state
of West Virginia.
Be it enacted by the Legislature of West Virginia:
That the code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §5A-8-22, to read as
follows:
ARTICLE 8. PUBLIC RECORDS MANAGEMENT AND PRESERVATION.
§5A-8-22. Personal information maintained by state entities.
The following information maintained by state entities with
respect to individuals and their dependants, is personal
information, is hereby exempted from disclosure under the
provisions of article one, chapter twenty nine-b of this code, and
may not be released by state agencies or entities to nonstate entities, unless necessary to an essential function of a state
agency or entity, or law-enforcement agency, or required by law:
Home address, social security number, home telephone number,
payroll deductions, credit card numbers, debit card numbers,
driver's license identification number, marital status and maiden
name.
NOTE: The purpose of this bill is to protect individuals' and
their dependants' personal information from inappropriate
disclosure.
