A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §18C-7-8, relating to
redemption or repayment of PROMISE scholarship funds when a
student drops or withdraws from classes; Higher Education
Policy Commission rule-making authority; and emergency
situations exempted.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §18C-7-8, to read as
follows:
ARTICLE 7. WEST VIRGINIA PROVIDING REAL OPPORTUNITIES FOR
MAXIMIZING IN-STATE STUDENT EXCELLENCE SCHOLARSHIP
PROGRAM.
§18C-7-8. Repayment of tuition and fees for dropped classes.
(a) The PROMISE scholarship may not be used to pay for courses dropped by a student or courses from which a student has withdrawn
after the end of the add/drop period. The board shall notify
eligible recipients of the provisions of this subsection and each
institution receiving PROMISE scholarship funds shall notify award
recipients of the provisions of this subsection during the
registration process.
(b) Redemption of PROMISE scholarship funds which fall under
subsection (a) of this section, shall be taken out of a student's
PROMISE scholarship award for the following term or semester. If
a student graduates or fails to return to school repayment shall be
made directly to the Higher Education Policy Commission and then be
directly deposited into the PROMISE scholarship fund.
(c) In emergency situations including, but not limited to,
long-term health issues of the student, death of a parent or
guardian or death of a child or spouse redemption and repayment may
be excused. Evaluations of students seeking this exemption shall
be done on a case-by-case basis.
(d) The West Virginia Higher Education Policy Commission shall
promulgate rules to implement the provisions of this section
pursuant to the provisions of section five, article three, chapter
twenty-nine-a of this code.
NOTE: The purpose of this bill is to grant the Higher
Education Policy Commission rule-making authority to redeem or
secure repayment of PROMISE scholarship funds from students who
withdraw or drop classes.
This section is new; therefore, it has been completely
underscored.
