A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §8-12-15f, relating
to authorizing Class I and Class II municipalities to regulate
taxies and taxi stands.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §8-12-15f, to read as
follows:
ARTICLE 12. GENERAL AND SPECIFIC POWERS, DUTIES AND ALLIED
RELATIONS OF MUNICIPALITIES, GOVERNING BODIES AND
MUNICIPAL OFFICERS AND EMPLOYEES; SUITS AGAINST
MUNICIPALITIES.
§8-12-15f. Regulation of taxies.
Notwithstanding article two, chapter twenty-four-a of this
code, the governing body of a Class I or Class II municipality may,
by ordinance, regulate the transportation by motor-vehicle of passengers, for pay, within the limits of the municipality or from
points in the city to points beyond the limits of the municipality.
The regulations may include, but are not limited to:
(1) The number of companies;
(2) Imposing reasonable license fee;
(3) Regulations for the operation of vehicles;
(4) The rates to be charged for transportation; and
(5) The location of taxi stands.
NOTE: The purpose of this bill is to permit Class I and Class
II municipalities to regulate taxi stands.
