A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §5-16-18a, relating
to underwriting of nonstate employer groups by the Public
Employees Insurance Agency.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §5-16-18a, to read as
follows:
ARTICLE 16. WEST VIRGINIA PUBLIC EMPLOYEES INSURANCE ACT.
§5-16-18a. Nonstate employer underwriting.
The director may, by rule as authorized by section nine of
this article, establish reasonable underwriting criteria for
nonstate employers participating in the plan, including, but not
limited to, minimum participation requirements and minimum contract
periods.
NOTE: The purpose of this bill is to authorize the Director of
the Public Employees Insurance Agency to promulgate rules for
underwriting requirements for nonstate employers which participate
with the agency.
