A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §31B-1-114, relating
to the creation of a criminal penalty for knowingly filing
materially false information regarding a limited liability
company with the Secretary of State.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §31B-1-114, to read as
follows:
§31B-1-114. Penalty for signing false document.
Any person who signs a document he or she knows is false in
any material respect and knows that the document is to be delivered
to the Secretary of State for filing is guilty of a misdemeanor
and, upon conviction thereof, shall be fined not more than $1,000
or confined in jail not more than one year, or both fined and
confined.
