SECOND DAY

[Mr. Speaker, Mr. Thompson, in the Chair]

                              

     The House of Delegates met at 11:00 a.m., and was called to order by the Honorable Richard Thompson, Speaker.
     Prayer was offered and the House was led in recitation of the Pledge of Allegiance.
     The roll being called (Roll No. 489), and 88 members having answered to their names, the Speaker declared the presence of a quorum.
     The Clerk proceeded to read the Journal of Thursday, July 15, 2010, being the first order of business, when the further reading thereof was dispensed with and the same approved.
     At 11:08 a.m., on motion of Delegate Boggs, the House of Delegates recessed until 1:00 p.m., subject to the call of the Chair.

     Following the recess, the House met again at 1:20 p.m., and was called to order by the Speaker.

Second Reading

     Com. Sub. for H. B. 201, United States Senatorial succession; on second reading, coming up in regular order, was read a second time.
     At the request of Delegate Boggs, and by unanimous consent, the bill was advanced to third reading and the rule was suspended to permit the offering and consideration of amendments on that reading.
Messages from the Senate

     A message from the Senate, by
     The Clerk of the Senate, announced the passage by the Senate and requested the concurrence of the House of Delegates in the passage, to take effect from passage, of        
     Com. Sub. for S. B. 2001 - "A Bill to amend and reenact §3-1-44 of the Code of West Virginia, 1931, as amended; to amend and reenact §3-10-1 and §3-10-3 of said code; and to amend said code by adding thereto a new section, designated §3-10-4a, all relating to vacancies in the office of United States Senator; requiring the state to pay costs incurred in connection with a special election to fill a vacancy in the office of United States Senator; making technical amendments; clarifying the procedure for filling vacancies in the office of United States Senator; providing that any vacancy occurring in the office of United States Senator is filled by the Governor by appointment with the advice and consent of the Senate; specifying when an election is required to fill a vacancy in the office of United States Senator; setting forth procedures for the nomination of candidates for an election to fill a vacancy in the office of United States Senator; requiring a special primary election for the nomination of political party candidates under certain circumstances; setting forth requirements for a Governor's proclamation; establishing certain time frames and guidelines for conducting elections to fill a vacancy in the office of United States Senator; providing that the Secretary of State may modify ministerial election duties, deadlines or procedures in connection with an election to fill a vacancy in the office of United States Senator; and providing an effective date."
     At the respective requests of Delegate Boggs, and by unanimous consent, reference of the bill (Com. Sub. for S. B. 2001) to a committee was dispensed with, and it was taken up for immediate consideration, read a first time and ordered to second reading.
Leaves of Absence

     At the request of Delegate Boggs, and by unanimous consent, leaves of absence for the day were granted Delegates Argento, Caputo, Ennis, Hall, Hunt, C. Miller, Schadler, Shook, Staggers, Stephens, Stowers and Varner.
     At 1:29 p.m., the House of Delegates adjourned until 11:00 a.m., Saturday, July 17, 2010.
