A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §60-2-23, relating to providing for career development for Alcohol Beverage Control inspectors, enforcement agents and supervisors; establishing annual salaries; and providing rule-making authority.

Be it enacted by the Legislature of West Virginia:

    That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §60-2-23, to read as follows:

ARTICLE 2. ALCOHOL BEVERAGE CONTROL COMMISSIONER.

§60-2-23. Career Development; salaries.

    (a) The commissioner shall establish within the Alcohol Beverage Control Commission a system to provide for the career development and promotion of inspectors and enforcement agents.

    (b) The commissioner may propose legislative rules for promulgation in accordance with article three, chapter twenty-nine-a of this code for the purpose of ensuring consistency, predictability and independent review of any system developed under the provisions of this section.

    (c) The commissioner will provide to each inspector, enforcement agent and supervisor a written manual governing any system established under the provisions of this section and specific procedures shall be identified for the evaluation and testing of inspectors and enforcement agents for advancement.

    (d) Beginning July 1, 2011, until and including the June 30 2012, inspectors, enforcement agents and supervisors shall receive annual salaries as follows:

    Each inspector, enforcement agent and supervisor of the Alcohol Beverage Commission whose salary is fixed and specified in this annual salary schedule is entitled to the length of service increases set forth in subsection (e) of this section.

    (e) Each inspector, enforcement agent and supervisor of the Alcohol Beverage Commission whose salary is fixed and specified pursuant to this section will receive, and is entitled to, an increase in salary over that set forth in subsection (d) of this section based on length of service, including that service served before and after the effective date of this section with the Alcohol Beverage Commission as follows: At the end of two years of service with the Alcohol Beverage Commission, the inspector, enforcement agent and supervisor will receive a salary increase of $400 to be effective during his or her next year of service and a like increase at yearly intervals thereafter, with the increases to be cumulative.

    (f) In applying the salary schedules set forth in this section where salary increases are provided for length of service, inspectors, enforcement agents and supervisors of the Alcohol Beverage Commission in service at the time the schedules become effective will be given credit for prior service and will be paid the salaries the same length of service entitles them to receive under the provisions of this section.


    NOTE: The purpose of this bill is to provide for career development and establishing a pay scale for Alcohol Beverage Commission inspectors, enforcement agents and supervisors. The bill also provides rulemaking authority.
