A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §18-5-1d, relating to
prohibiting members of the same family within a certain degree
of relationship to occupy more than one seat on a board of
education simultaneously.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §18-5-1d, to read as
follows:
ARTICLE 5. COUNTY BOARD OF EDUCATION.
§18-5-1d. Disqualification from county board membership.
(a) Notwithstanding any other provision of this code, two or
more individuals who share at least a second degree of relationship
with each other may not serve on the same county school board at
the same time. This second degree of relationship includes the individual and their
spouse and:
(1) Their brothers;
(2) Sisters;
(3) Step-brothers;
(4) Stepsisters;
(5) Half-brothers;
(6) Half-sisters;
(7) Father;
(8) Mother;
(9) Stepfather;
(10) Stepmother;
(11) Son;
(12) Daughter;
(13) Step children;
(14) Son-in-law;
(15) Mother-in-law;
(16) Daughter-in-law;
(17) Brother-in-law; and
(18) Sister-in-law.
(b) This section may not be waived by any vote of the
applicable county board.
NOTE: This bill shall prohibit members of the same family
within a certain degree of relationship to occupy more than one
seat on a Board of Education simultaneously.
