A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §16-13A-26, relating to public service districts; providing that after the 2020 census, public service districts are to be combined into one district for each county; that the current system is to remain in effect until 2022 when there will be only one public service district in a county; and that the members of the one public district board are to be elected, one from each magisterial district in the county.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §16-13A-26, to read as follows:

ARTICLE 13A. PUBLIC SERVICE DISTRICTS.


§16-13A-26. One public service district per county beginning in 2020; members elected from each magisterial district.

Notwithstanding any other provision of this code to the contrary, following the 2020 census, there shall be only one public service district in each county.  The existing public service districts shall continue until 2022 when they shall be combined into one public service district for each county.  Members of the one public service district shall be elected, one from each magisterial district of the county. Unless altered by the Legislature, the remaining provisions of this article, which are not in conflict with this section, shall remain in effect and operation.


 

NOTE: The purpose of this bill is to provide that after the 2020 census, public service districts are to be combined into one district for each county and that the current system is to remain as is until 2022 when there will be only one public service district in a county.  The members of the one public service district board are to be elected, one from each magisterial district in the county.
