A BILL to amend the Code of West Virginia,1931, as amended, by adding thereto a new section, designated §16-9A-6, relating to electronic cigarettes and vapor products; requiring the listing of the ingredients contained in the products; and prohibiting the sale of unlabeled vapor products.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §16-9A-6, to read as follows:

ARTICLE 9A. TOBACCO USAGE RESTRICTIONS.


§16-9A-6. Required labeling of vapor products.

All vapor products, whether or not that product contains nicotine, offered for sale in this state must be labeled with a list of the ingredients, arranged by weight in descending order, contained in the portion of the product that is consumed, vaporized or released during the use of the product.  No person or business entity may sell or offer for sale any unpackaged vapor product that does not bear this label.

NOTE: The purpose of this bill is to require the listing of the ingredients contained in vapor products; and prohibit the sale of unlabeled vapor products.
