A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §21-5A-12, relating
to creating health savings accounts for prevailing wage
employees.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §21-5A-12, to read as
follows:
ARTICLE 5A. WAGES FOR CONSTRUCTION OF PUBLIC IMPROVEMENTS.
§21-5A-12. Health savings accounts for prevailing wage employees.
In all cases where any public authority has ascertained a fair
minimum rate or rates of wages as herein provided, and construction
of a public improvement is let to contract, the contract executed
between the public authority and the successful bidder shall
contain a provision requiring the successful bidder and its
subcontractors to deposit fifteen percent of each prevailing wage dollar paid to his or her employees into a health savings account
created by the employee. This section does not apply to a bidder
or a subcontractor providing health insurance for its employees.
This section does not apply to self-insured employees. The State
Commissioner of Labor shall propose rules for legislative approval
in accordance with chapter twenty-nine-a of the Code of West
Virginia, one thousand nine hundred thirty-one, as amended, as
shall be necessary to give effect to this section.
NOTE: The purpose of this bill is to create health savings
accounts for prevailing wage employees.
