A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §22C-4-31, relating
to requiring that
solid waste authority site plans be
considered approved unless the solid waste authority
disapproves the plan within sixty days
.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §22C-4-31, to read as
follows:
ARTICLE 4. COUNTY AND REGIONAL SOLID WASTE AUTHORITIES.
§22C-4-31. Site plans approved unless disapproved.
Any site plan submitted by a county or regional solid waste
authority will be considered to be approved unless, within sixty
days after its submission, the solid waste management authority
shall have disapproved the plan by written decision setting forth its findings of fact and conclusions of law forming the basis of
the disapproval.
NOTE:
The purpose of this bill is to
require that solid waste
authority site plans be considered approved unless the solid waste
authority disapproves the plan within sixty days.
