A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new article, designated §16-2J-1, relating to
requiring that nursing services provided at facilities that
provide abortions be under the direction of a legally and
professional qualified registered nurse.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new article, designated §16-2J-1, to read as
follows:
ARTICLE 2J. MISCELLANEOUS PROVISIONS REGARDING ABORTION.
§16-2J-1. Nursing services at facilities providing abortions.
The Health Department shall license, regulate, and perform
weekly inspections of every facility in which three or more
abortions are performed in a calendar year.
Cases in which a hospital performs an abortion to save the life of a person who is in imminent danger shall not be considered,
in determining what facilities fall within the scope of this
statute.
Nothing in this section shall be construed or interpreted to
condone, permit, allow or endorse any abortion.
NOTE:
The purpose of this bill is to
require that the nursing
services at any facility that provides abortions be under the
direction of a registered nurse.
