A BILL to amend article fifteen, chapter twenty-two of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section five-a, relating to restricting sewage sludge from being disposed of or dumped within 1000 feet of any occupied dwelling and requiring the director to modify any existing rules applicable to this restriction.

Be it enacted by the Legislature of West Virginia:
That article fifteen, chapter twenty-two of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section five-a, to read as follows:
ARTICLE 15. SOLID WASTE MANAGEMENT ACT.

§22-15-5a. Sewage sludge may not be dumped within one thousand feet of any occupied dwelling; director to modify rules.

Notwithstanding any provision of this code or any rule promulgated by the director to the contrary, sewage sludge may not be disposed of or dumped within one thousand feet of any occupied dwelling. The director shall modify any existing rules that are applicable to carry out the provisions of this section.


NOTE: The purpose of this bill is to restrict sewage sludge from being disposed of or dumped within 1000 feet of an occupied dwelling and requiring the director to modify any existing rules applicable to this restriction.
