A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §7-20-3a, relating to
expanding the definition of capital improvements and services
which may be funded with county impact fees to include
libraries, library services and affordable housing for
individuals or families with low or moderate income.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §7-20-3a, to read as
follows:
ARTICLE 20. FEES AND EXPENDITURES FOR COUNTY DEVELOPMENT.
§7-20-3a. Additional definitions.
(a) "Capital improvements" also mean:
(1) Libraries that are owned, supported or established by
county government; and
(2) Facilities that are owned, operated or established by
county government and are determined by the county commission to be
necessary for the administration and provision of affordable
housing for individuals or families of low or moderate income,
pursuant to a program to provide affordable housing that is
authorized by law and approved by the county commission.
(b) "County services" also mean:
(1) Library services; and
(2) Services of administering and providing affordable housing
for individuals or families of low or moderate income, pursuant to
a program to provide affordable housing that is authorized by law
and approved by the county commission.
NOTE:
The purpose of this bill is to authorize county
commissions to use impact fees to fund the building and operation
of libraries and to administer and provide affordable housing for
individuals or families of low or moderate income.
