A BILL to amend
the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §5A-3-10d, relating
to requiring bids under state contracts to specify the
location of the work to be performed; and authorization to
terminate contract.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §5A-3-10d, to read as
follows:
ARTICLE 3. PURCHASING DIVISION.
§5A-3-10d. Location of work requirement.
(a) All bids submitted under this article shall include an
affidavit by the bidder specifying the location of the work to be
performed pursuant to the contract.
(b) Subsequent to the awarding of a contract, if the location of the work performed or any portion of the work performed pursuant
to the contract awarded under the provisions of this article is
changed, then the bidder shall notify the division in writing
within 30 days of the change.
(c) The division may terminate any contract if the location of
the work performed or any portion of the work performed pursuant to
the contract awarded under the provisions of this article is
changed and the change is not reported to the division.
NOTE: The purpose of this bill is to require bids under state
contract to disclose the location of work to be performed or risk
state termination of the contract.
