A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §30-1-21, relating to health care professionals providing services in federal veterans’ affairs facilities in this state; authorizing those health care professionals to provide services to patients or residents of state-run veterans’ facilities without obtaining an authorization to practice from the appropriate licensing agency of this state.

Be it enacted by the Legislature of West Virginia:

            That the Code of West Virginia, 1931, as amended, be amended and reenacted by adding thereto a new section, designated §30-1-21, to read as follows:

ARTICLE 1. GENERAL PROVISIONS APPLICABLE TO ALL STATE BOARDS OF EXAMINATION OR REGISTRATION REFERRED TO IN CHAPTER.

§30-1-21. Exemption from professional licensure for veterans’ providers.

            (a) For the purposes of this section, “health care professional” means any individual appointed by the federal government to provide services in a United States Veterans Affairs facility within this state, pursuant to 38 U.S.C. § 7401, regardless of the jurisdiction in which that individual holds a professional license in good standing.

            (b) Notwithstanding any other provision of this code, a health care professional providing services within this state on behalf of a United States Veterans Affairs health care facility is exempt from obtaining a license or authorization to practice from the appropriate professional licensing board of this state while providing services to a patient of a state-run veterans’ health care facility or a resident of a state-run veterans’ nursing home.

            (c) Notwithstanding any other provision of this code, any health care professional providing services within this state on behalf of a United States Veterans Affairs health care facility is authorized to provide services and prescribe pharmaceutical drugs to a patient of a state-run veterans’ health care facility or a resident of a state-run veterans’ nursing home within the same limits as his or her authorization to practice in a United States Veterans Affairs health care facility within this state.

 

 

 

            NOTE: The purpose of this bill is to authorize health care professionals providing services in federal veterans’ affairs facilities in this state to provide services to patients or residents of state-run veterans’ facilities without obtaining an authorization to practice from the appropriate licensing agency of this state.
