SENATE CONCURRENT RESOLUTION NO. 19

(Originating in the Committee on Government Organization)




Directing the Joint Committee on Government Operations to make a study to determine whether West Virginia is in compliance with the newly enacted federal law concerning access for persons with disabilities.

Whereas, The "Americans with Disabilities Act" was signed into law by President Bush on July 26, 1990; and
Whereas, The act requires that all public buildings and accommodations have adequate accessibility to persons with disabilities; and
Whereas, The act does not give specific directives as to state oversight of its accessibility requirements; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government Operations is hereby directed to review, examine and study the requirements of the "Americans with Disabilities Act" and determine whether the state is in compliance with the act, whether adequate recourse is in place for citizens to complain or request information on accessibility problems, the ways and means to address any accessibility problems or concerns and the manner in which the state should oversee federal requirements; and, be it
Further Resolved, That the Joint Committee on GovernmentOperations report to the regular session of the Legislature, 1994, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it
Further Resolved, That the expenses necessary to conduct this study, to prepare a report and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government Operations.
