A BILL to amend article five-c, chapter twenty-one of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section three-a, relating to mandatory rest periods for employees.

Be it enacted by the Legislature of West Virginia:
That article five-c, chapter twenty-one of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section three-a, to read as follows:
ARTICLE 5C. MINIMUM WAGE AND MAXIMUM HOURS STANDARDS FOR EMPLOYEES.

§21-5C-3a. Rest periods for employees.

On and after the first day of July, two thousand two, no employer may require any employee to work without a rest period of at least ten minutes during every four hours worked: Provided, That this section does not apply to employees who are under the federal Railway Labor Act. These rest periods shall be in addition to the regularly scheduled lunch period. No reduction in compensation may be imposed on an employee as the result of an employer's compliance with this section.

NOTE: The purpose of this bill is to provide for mandatory rest periods for employees.
