AN ACT to amend and reenact §64-2-1 and §64-2-2 of the Code of West Virginia, 1931, as amended, all relating generally to the promulgation of legislative rules by various executive or administrative agencies of the state; authorizing certain agencies to promulgate certain legislative rules with various modifications presented to and recommended by the Legislative Rule-Making Review Committee; authorizing the Board of Risk and Insurance Management to promulgate a legislative rule relating to the Patient Injury Compensation Fund; authorizing the Board of Risk and Insurance Management to promulgate a legislative rule relating to mine subsidence insurance; and authorizing the Ethics Commission to promulgate a legislative rule relating to the use of office for private gain, including nepotism.

Be it enacted by the Legislature of West Virginia:


That §64-2-1 and §64-2-2 of the Code of West Virginia, 1931, as amended, be amended and reenacted, all to read as follows:

ARTICLE 2. Authorization for Department of ADMINISTRATION to promulgate legislative rules.

§64-2-1. Board of Risk and Insurance Management.


(a) The legislative rule filed in the State Register on August 22, 2016, authorized under the authority of section two, article twelve-d, chapter twenty-nine of this code, modified by the Board of Risk and Insurance Management to meet the objections of the Legislative Rule-Making Review Committee and refiled in the State Register on December 12, 2016, relating to the Board of Risk and Insurance Management (Patient Injury Compensation Fund, 115 CSR 07), is authorized.

(b) The legislative rule filed in the State Register on August 22, 2016, authorized under the authority of section fifteen, article thirty, chapter thirty-three of this code, modified by the Board of Risk and Insurance Management to meet the objections of the Legislative Rule-Making Review Committee and refiled in the State Register on December 12, 2016, relating to the Board of Risk and Insurance Management (mine subsidence insurance, 115 CSR 01), is authorized.

§64-2-2. Ethics Commission.


The legislative rule filed in the State Register on August 23, 2016, authorized under the authority of section two, article two, chapter six-b of this code, modified by the Ethics Commission to meet the objections of the Legislative Rule-Making Review Committee and refiled in the State Register on December 19, 2016, relating to the Ethics Commission (use of office for private gain, including nepotism, 158 CSR 06), is authorized.
