A BILL to amend and reenact sections one and four, article
seven-a, chapter eighteen of the code of West Virginia, one
thousand nine hundred thirty-one, as amended, relating to
the state teachers retirement system and renaming this
article the education employees retirement system; and
changing the name of the state teachers retirement board to
the education employees board.
Be it enacted by the Legislature of West Virginia:
That sections one and four, article seven-a, chapter
eighteen of the code of West Virginia, one thousand nine hundred
thirty-one, as amended, be amended and reenacted to read as
follows:
ARTICLE 7A. EDUCATION EMPLOYEES RETIREMENT SYSTEM.
§18-7A-1. Establishment of retirement system.
A retirement system to be known as the "
state teachers
education employees retirement system" is hereby established for
the purpose of providing retirement allowances for the teachers
of West Virginia.
That at all times material herein mentioned in
this article, the "state teachers retirement system" shall mean
the "education employees retirement system."
§18-7A-4. Education employees retirement board.
The general administration and the management of the
retirement system are hereby continued in
a "teachers an
"education employees retirement board" through the thirtieth day
of June, one thousand nine hundred ninety-one, and thereafter, in
the consolidated public retirement board created by article
ten-d, chapter five of this code.
That at all times material
herein mentioned in this article, the "teachers retirement board"
shall mean the "education employees retirement board." The
retirement board shall have the right to sue and be sued, plead
and be impleaded, contract and be contracted with and shall make
all necessary rules
and regulations to carry out the provisions
of this article. All of the business of the board shall be
transacted, all of its funds invested, all warrants for money
drawn and payments made, and all of its cash and securities and
other property shall be held in the name of the
"teachers
"education employees retirement
board system."
NOTE: The purpose of this bill is to rename the "state
teachers retirement system" to the "education employees
retirement system" and rename the "teachers retirement board" to
the "education employees retirement board." These changes are
necessary to conform to present law.
