A BILL to amend article two, chapter twenty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section sixty-
four, relating to special use fishing permits for designated
areas under special management; promulgation of rules; and
fee.
Be it enacted by the Legislature of West Virginia:
That article two, chapter twenty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
sixty-four, to read as follows:
ARTICLE 2. WILDLIFE RESOURCES.
§20-2-64. Special use permits for fishing designated areas
under special management.
On or after the first day of January, one thousand nine
hundred ninety-four, a special use permit shall be required to be
purchased to permit persons to fish along and in the CranberryRiver. The director of the division of natural resources is
authorized to promulgate rules, in accordance with article three,
chapter twenty-nine-a of this code, regarding these special use
permits which shall be known as the "Cranberry River Permit".
The special use permit shall be an annual permit and the cost of
such permit shall not exceed five dollars per annum. This
special permit shall be in addition to any other licenses or
permits required by this article. The proceeds from the fee for
the "Cranberry River Permit" shall be deposited in a special
revenue account hereby created in the state treasury; and shall
be known as the "Cranberry River Fund" and shall be expended
solely to treat the water in the river as to neutralize the
acidity level in the Cranberry River:
Provided,
That funds may
only be expended upon line item appropriation by the Legislature:
Provided, however,
That amounts collected which are found from
time to time to exceed funds needed for the purposes set forth in
this section may be transferred to other accounts or funds and
redesignated for other purposes by appropriation of the
Legislature.
