HB2002 HFA Hansen 2-17

            Delegate Hanson moves to amend Com Sub to HB2002 on page 16, section 10, lines 13 through 16, by striking out subdivision (iii) in its entirety, and inserting in lieu thereof, the following:

“(iii) To the extent allowable by law, make state owned natural watercourses and drainages categorically approved as potential pathways for broadband conduit rights-of-way, and create a streamlined procedure for applicants to achieve state approval for such use, and pre-identify locations where such use as right-of-way would qualify for federal nationwide permitting: Provided, That such use is limited to the state’s major rivers with mean annual stream flow greater than 8,000 cubic feet per second and such use is limited to laying conduit on the riverbed and does not require trenching or other disturbance of the riverbed.”
