Delegate Fleischauer moves to amend Com. Sub for HB2002 on page 39, Section 2, line 6, following the words “or deployment” by striking out the period and inserting the following:

 

 “except that a political subdivision may, with respect to public right-of-way it controls and maintains, deny a proposed installation or modification if it:

(1) Materially interferes with the safe operation of traffic control equipment;

(2) Materially interferes with sight lines or clear zones for transportation or pedestrians;

(3) Materially interferes with compliance with the Americans with Disabilities Act or similar federal or state standards regarding pedestrian access or movement; or

(4) Fails to comply with applicable codes, legislative rule, and generally applicable standards that are consistent with this chapter and adopted by an authority for construction and public safety in the rights-of-way, including reasonable and nondiscriminatory wiring and cabling requirements, grounding requirements, and abandonment and removal provisions.”
