The Committee on Health and Human Resources moved the bill on page 1, line 15, by striking the words, “an individual who is present at, or presented at,” and inserting the words, “an individual who presents for treatment, or presented for treatment”;

And,

On page 1, line 14, after the word, “physician” by inserting, “or other mental health professional”;

And,

On page 2, line 19, after the period by inserting the following: “The physician shall sign a statement attesting to his or her decision that the patient presents as a harm to him or herself or others and needs to be held involuntarily for up to 72 hours.  A copy shall be provided to the patient.”

 And,

On page 3, line 51, by inserting a new subsection (g) to read as follows:

“(g) No action taken against an individual pursuant to this section may be construed to be an adjudication of the individual, nor shall any action taken pursuant to this section be construed to satisfy the requirements of WV Code §61-7-7(a)(4).”
