Delegate Cowles moved to amend the bill on page 1, section 25, line 11, by striking subsection (c) in its entirety and inserting a new subsection (c) to read as follows:

“(c) If the secretary determines a new specialized long-term care facility is needed, the new specialized long-term care facility shall be located on the property of the current Jackie Withrow Hospital.”


On page 1, line 17, by striking subsection (d) in its entirety; and renumber the remaining subsections accordingly;


On page 3, after line 60, by inserting a new subsection (l) to read as follows:

“(l) For the purposes of this section a “specialized long-term care facility” means a facility that serves residents who:

(1) Are high acuity patients; and

(2) May present as a danger to themselves or others, may have a criminal background, residents with psychiatric and behavioral disorders, traumatic brain injury with varying neurological disorders, geri-psychiatric, individuals with intellectual and developmental disabilities, as well as Alzheimer’s disease or dementia with combative behaviors.”


To amend the bill by striking out the title and substituting therefor a new title, to read as follows:

“Eng. Com. Sub. for House Bill No. 3102 -- A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §9-5-25, relating to the selling of certain assets by the Secretary of the Department of Health and Human Resources; defining terms; ensuring the transfer of existing patients; permitting construction of a replacement facility; specifying the location of the replacement facility; exempting certain laws; creating a fund; implementing a benefits package for employees; providing for an accounting; and providing statutory construction.”
