TWENTY-EIGHTH DAY

[Mr. Speaker, Mr. Thompson, in the Chair]

                              

     The House of Delegates met at 11:00 a.m., and was called to order by the Honorable Rick Thompson, Speaker.
     Prayer was offered and the House was led in recitation of the Pledge of Allegiance.
     The Clerk proceeded to read the Journal of Monday, February 6, 2012, being the first order of business, when the further reading thereof was dispensed with and the same approved.
Committee Reports

     Chairman Perdue, from the Committee on Health and Human Resources, submitted the following report, which was received:
     Your Committee on Health and Human Resources has had under consideration:
     H. B. 4098, Providing a loan forgiveness program for dentists and hygienists,
     And reports the same back, with amendment, with the recommendation that it do pass, as amended, but that it first be referred to the Committee on the Judiciary, and with the further recommendation that it be referred to the Committee on Finance.
     In accordance with the former direction of the Speaker, the bill (H. B. 4098) was referred to the Committee on the Judiciary, and in the absence of objection, was further referred to the Committee on Finance.

B. 360 - "A Bill to amend and reenact §11-10-13f of the Code of West Virginia, 1931, as amended; and to amend said code by adding thereto a new section, designated §38-1-16, all relating to creating a procedure for deeming personal property abandoned following a transfer of real property by tax sale or foreclosure; requiring notice to the owner of personal property remaining on real property after the previous owner has vacated; creating a procedure for notice and setting a thirty-day period for removal of personal property; giving the purchaser of real property the authority to remove personal property after proper notice and waiting period; and prohibiting waiver of notice requirement prior to vacation of property"; which was referred to the Committee on the Judiciary.

     A message from the Senate, by

     S. B. 470 - "A Bill to amend and reenact §18-7A-25 of the Code of West Virginia, 1931, as amended, relating to medical examinations to qualify for a disability annuity under the Teachers Retirement System"; which was referred to the Committee on Pensions and Retirement then Finance.
Resolutions Introduced

     Delegate Barker offered the following resolution, which was read by its title and referred to the Committee on Rules:
     H. C. R. 51 - "Requesting the Division of Highways to name the bridge on Route 85, at Greenwood in Boone County, bridge number 3-85-7.71, as the 'Robert Earchil Adams Memorial Bridge'."
     Whereas, Robert Earchil Adams was born on August 25, 1975 to Stanley "Butch" and Sue Adams; and
     Whereas, Robert Earchil Adams had a love of football and began playing when he was seven years old and played for the varsity at Van High School; and
     Whereas, Robert Earchil Adams graduated from Van High School in 1994 and had his jersey number 55 retired; and
     Whereas, In 1996 Robert Earchil Adams was proud of his decision to join the United States Army and although he was anxious about leaving, he was also excited about becoming a ranger and jumping out of planes; and
     Whereas, Robert Earchil Adams died on February 4, 1996, just ten days before he was scheduled to leave for the U. S. Army; and
     Whereas, It is fitting to honor Robert Earchil Adams for his commitment to his nation and his community; therefore, be it
     Resolved by the Legislature of West Virginia:
     That the Legislature hereby requests the Division of Highways to name the bridge on Route 85 at Greenwood, in Boone County, bridge number 3-85-7.71, as the "Robert Earchil Adams Memorial Bridge"; and, be it
     Further Resolved, That the Division of Highways is hereby requested to have made and be placed signs identifying the bridge as the "Robert Earchil Adams Memorial Bridge"; and, be it

     H. B. 4271, Reporting requirements for residential mortgage lenders and broker licensees; on second reading, coming up in regular order, was read a second time and ordered to engrossment and third reading:
     Com. Sub. for H. B. 4356, Creating the misdemeanor offense for child neglect resulting in a substantial risk of bodily injury; on second reading, coming up in regular order, was read a second time, advanced to third reading with the amendments pending and the rule was suspended to permit the offering and consideration of such amendments on that reading.
     Amendments filed with the Clerk, to be considered on third reading, were as follows:
No. 1.By Delegates Marcum, Lawrence, Hall, Moore, H. White, L. Phillips, Nelson, Ferns, R. Phillips:
     On page three, section four, subsection (c), line twenty-four, after the word "child", by inserting a comma and the words "then the parent, guardian or custodian".
     On page three, section four, subsection (d), line thirty-two, after the word "child", by striking out the remainder of the subsection and inserting in lieu thereof a comma and the words "then the parent, guardian or custodian, is guilty of a misdemeanor and, upon conviction thereof, for a first offense,shall be fined not less than $500 nor more than $1,000 or confined in jail not less than thirty days nor more than six months or both fined and confined. All persons convicted of a first offense under this subsection shall also be required to complete a parenting plan and parenting education class. For a second offense, the parent, guardian or custodian is guilty of a misdemeanor and, upon conviction thereof, shall be fined no more than $1,000 and confined in jail not less than thirty days nor not more than one year. For a third or subsequent offense, the parent, guardian or custodian is guilty of a felony and, upon conviction thereof, shall be fined not more than $2,000 and imprisoned in a state correctional facility not less than one year nor more than three years."

     On page four, section four, line thirty-six, by inserting a new subsection to read as follows:
     "(e) Any person who abuses alcohol or uses drugs not administered for medical treatment and, as a result, gives birth to an infant diagnosed with fetal alcohol syndrome or with the presence of any amount of a controlled substance or a metabolite of a controlled substance in his or her blood, urine or meconium and such presence is not the result of medical treatment administered to the mother or the infant, is guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than $100 nor more than $1,000 and confined to jail for not more than one year; Provided, That, any person convicted pursuant to this subsection may elect to obtain treatment from a drug and alcohol rehabilitation program for a minimum of ninety days and upon completion of the program may petition the court for expungement."
     And,
     By relettering the remaining subsections.
First Reading
