The House of Delegates met at 11:00 a.m., and was called to order by the Honorable Richard Thompson, Speaker.
Prayer was offered and the House was led in recitation of the Pledge of Allegiance.
The Clerk proceeded to read the Journal of Friday, January 11, 2008, being the first order of business, when the further reading thereof was dispensed with and the same approved.

Motions

At the request of Delegate DeLong, and by unanimous consent, the applicable provisions of House Rule 136, relating to privileges of the floor, were suspended for the remainder of the day to extend privileges of the floor to invited guests for a presentation by the House.
Resolutions Introduced

Delegates H. White and Kominar offered the following resolution, which was read by its title:
H. C. R. 7 - "Supporting the efforts of the Town of Matewan to obtain National Park status for the Matewan National Historic Landmark District."
Whereas, Matewan, West Virginia is a small town nestled in the Tug River Valley, rich in its history of coal mining and ties to its past through the legacies of the infamous Hatfield & McCoy Feud and the Matewan Massacre, both of which furthers the folklore and history of the State of West Virginia; and
Whereas, The Battle of Matewan Study Act which directed the Secretary of the Interior to conduct a special study of the sites and resources at Matewan, West Virginia to determine if these areas are suitable for designation in the National Park System; and
Whereas, United States Senators Robert C. Byrd and Jay Rockefeller and United States Congressman Nick Rahall worked diligently to pass America's Historical and Natural Legacy Study Act which appropriated funds for the Battle of Matewan Study Act; and
Whereas, Matewan, West Virginia will be greatly enriched by federal funding and see more tourism by a designation as a National Park.
Resolved by the Legislature of West Virginia:
That the Legislature of the State of West Virginia supports the efforts of the Town of Matewan to obtain National Park status for the Matewan National Historic Landmark District.
Further Resolved, That the Clerk of the House of Delegates is hereby requested to forward a certified copy of this resolution to the Tug Valley Chamber of Commerce President, Rod Smith, the mayor of the Town of Matewan, Sheila Kessler, and the members of the West Virginia Congressional delegation.
At the respective requests of Delegate DeLong, and by unanimous consent, reference of the resolution (H. C. R. 7) to a committee was dispensed with, and it was taken up for immediate consideration.
The question now being on the adoption of the resolution, the yeas and nays were demanded, which demand was sustained.
The yeas and nays having been ordered, they were taken (Roll No. 2), and there were--yeas 93, nays none, absent and not voting 7, with the absent and not voting being as follows:

B. 4045 - "A Bill to amend and reenact §5-10C-3, §5-10C-4 and §5-10C-5 of the Code of West Virginia, 1931, as amended, all relating to government employees retirement plans; adding the West Virginia Emergency Medical Services Retirement System to, and clarifying that all other retirement systems administered by the Consolidated Public Retirement Board are included in, the definition of retirement systems for purposes of the employer pick-up provisions; clarifying that all participating public employers in retirement systems covered by this article are included in the definition of participating public employer; setting forth requirements for member contributions to be picked up for federal tax purposes by participating public employers in retirement systems covered by this article, in accordance with revised guidance relating to same from the Internal Revenue Service"; to the Committee on Pensions and Retirement then Finance.

Leaves of Absence

At the request of Delegate DeLong, and by unanimous consent, leaves of absence for the day were granted Delegates Campbell, Craig, Ennis, Hutchins, Miley and Tabb.
Delegate Marshall was also granted a leave of absence for the day due to the grave illness of her husband.
