The House of Delegates met at 11:00 a.m., and was called to order by the Speaker.
Prayer was offered and the House was led in recitation of the Pledge of Allegiance.
The Clerk proceeded to read the Journal of Friday, January 26, 2007, being the first order of
business, when the further reading thereof was dispensed with and the same approved.
At the request of Delegate DeLong, and by unanimous consent, the applicable provisions of
House Rule 136, relating to privileges of the floor, were suspended for the day to extend privileges
of the floor to invited guests for a presentation by the House.

Gentlemen:
In accordance with the provisions of W.Va. Code, §29A-3-12, we have attached copies of
all of the proposed legislative rules which have been submitted to and acted upon by the Legislative
Rule-Making Review Committee, pursuant to the provisions of W.Va. Code, §29A-3-11, and which
have not previously been submitted to the Legislature for study.
Also, attached is a report listing all of the proposed legislative rules considered by the
Committee and setting forth the recommendations of the Committee with respect to the proposed
legislative rules. This letter also serves as a statement that a separate bill authorizing the
promulgation of each proposed legislative rule has been drafted by the staff of the Legislative
Rule-Making Review Committee.
In accordance with W.Va. Code, §29A-3-11, the draft bills are available for any member to
introduce to the Legislature. The undersigned, as Co-Chairmen of the Legislative Rule-Making
Review Committee, are requesting that, except as set forth in the attached memorandum, the names
of all Committee members be placed upon the draft bills as sponsors in their respective houses.

the Committee with the modifications and with the recommendation that the rules be authorized for
adoption by the agencies with amendments:

Water and Waste Management, Division of
Standards for Beneficial Use of Filtrate from Water Treatment Plants, 33CSR9 [H. B. 2694].
The amendment removes Appendix A which establishes frequency of monitoring
requirements for filtrate being land applied. The amendment simply states that the filtrate shall be monitored once a year or every time a processing procedure is changed.
The amendment significantly reduces monitoring cost requirements, as the original rule
proposal required large land applications of greater that 15,000 dry tons of filtrate per year to be
monitored once a week, and smaller applications to be monitored monthly or quarterly.

Whereas, The dedicated employees of the Division of Corrections, the Regional Jail
Authority, and the Division of Juvenile Services are essential to the safe, secure, and humane
operation of the state's correctional facilities and offender supervision efforts; and
Whereas, They do so in an environment that requires constant vigilance and security and
in a manner that promotes the importance of programming and training in order to give the offender
the best chance of successful reentry into society; and
Whereas, They do so while always maintaining sensitivity and responsiveness to victims
of crime; and
Whereas, As a result of their service they are vital in the state's efforts to promote and
strengthen public safety and homeland security; therefore, be it
Resolved by the House of Delegates:
That the House hereby designates January 29, 2007, as "Corrections' Day"; and, be it
Further Resolved, That the House of Delegates hereby recognizes the exceptional service,
dedication and commitment of the employees of the Division of Corrections, the Regional Jail
Authority and the Division of Juvenile Services; and, be it
Further Resolved, That the Clerk of the House of Delegates is hereby requested to forward
a certified copy of this resolution to the appropriate officials of the Division of Corrections, the

Delegates Tabb and Wysong announced that they were absent on Friday when the vote was
taken on Roll No. 13, and that had they been present, they would have voted "Yea" thereon.
Remarks of Members
Delegate Armstead addressed the House concerning table games and the provisions of the
Constitution and at the conclusion of his remarks, Delegate Lane asked and obtained unanimous
