The House of Delegates met at 10:00 a.m., and was called to order by the Speaker.
Prayer was offered and the House was led in recitation of the Pledge of Allegiance.
The Clerk proceeded to read the Journal of Thursday, February 17, 2005, being the first order of business, when the further reading thereof was dispensed with and the same approved.

Mr. Speaker, Mr. Kiss, presented the annual report of the Commission on Special Investigations, for the period of July 1, 2003, to June 30, 2004, and additional copies were received by the Clerk and distributed to all the Members, with the original report filed in the Clerk's Office.
Mr. Speaker, Mr. Kiss, presented the 2004 annual report of the West Virginia Education and State Employees Grievance Board, in accordance with the provisions of the code; which was filed in the Clerk's Office.
Mr. Speaker, Mr. Kiss, presented the 2003 annual report of the West Virginia Court System, in accordance with section twelve-b, article one, chapter thirty of the code; which was filed in the Clerk's Office.
Mr. Speaker, Mr. Kiss, presented the 2004 annual report of the Workers' Compensation Office of Judges in accordance with section three, subsection two, article two, chapter ninety-three of the code; which was filed in the Clerk's Office.

B. 153 - "A Bill to amend and reenact §6B-2-4 and §6B-2-10 of the Code of West Virginia, 1931, as amended, all relating generally to the ethical standards of public officers and employees; providing for confidentiality requirements as to Ethics Commission members and staff, the Review Board, complainants and informants; prohibiting the submission of false information to the Commission; and providing for penalties"; which was referred to the Committee on the Judiciary.
Resolutions Introduced

Delegate Argento offered the following resolution, which was read by its title and referred to the Committee on Rules:

H. C. R. 14 --"Requesting the Division of Highways to name the bridge spanning the Gauley River on Route 39 near Summersville, Nicholas County, the 'Brock's Bridge'."
Whereas, The bridge over the Gauley River at Brock's Ferry was first built in 1904 at a cost of approximately $10,000; and
Whereas, For years this bridge was known by locals as the Brock's Bridge; and
Whereas, After the Gauley River was dammed and Summersville Lake was completed in the 1960's, a new bridge was constructed at Brock's Ferry; and
Whereas, Since the bridge over the Gauley River in this location has been historically known as the "Brock's Ferry Bridge," it is only fitting that the bridge be formally so named; therefore, be it
Resolved by the Legislature of West Virginia:
That the Legislature hereby requests the Division of Highways to name the bridge spanning the Gauley River on Route 39 near Summersville, Nicholas County, the "Brock's Bridge"; and, be it
Further Resolved, That the Division of Highways is hereby requested to erect appropriate signage at the entryway of each end of the bridge; and, be it

Petitions

Delegates Blair, Trump, Roberts, Overington and Duke presented a petition, signed by nine hundred twenty-six residents of the Eastern Panhandle, requesting the Legislature to reform the tax laws and the statutes governing workers' compensation; which was referred to the Committee on Finance.
Delegates Marshall and Beach presented a petition, signed by one hundred seventy-five students at West Virginia University School of Pharmacy, in support of authorizing collaborative pharmacy practice agreements between pharmacists and physicians; which was referred to the Committee on Health and Human Resources.

Delegate Staton moved that the constitutional rule requiring the bill to be fully and distinctly read on three different days be dispensed with.
On this question, the yeas and nays were taken (Roll No. 32), and there were--yeas 91, nays none, absent and not voting 9, with the absent and not voting being as follows:
Absent And Not Voting: Brown, Eldridge, Ennis, Ferrell, Fragale, Hamilton, Schoen, Swartzmiller and Tucker.
So, four fifths of the members present having voted in the affirmative, the constitutional rule was dispensed with.
Having been engrossed, the bill was then read a third time and put upon its passage.
The question being on the passage of the bill, the yeas and nays were taken (Roll No. 33), and there were--yeas 91, nays none, absent and not voting 9, with the absent and not voting being as follows:

Delegate Eldridge noted to the Clerk that he was absent when the votes were taken on Roll Nos. 31 through 34, and that had he been present, he would have voted "yea" thereon.
