SENATE CONCURRENT RESOLUTION NO. 48

Requesting the Joint Committee on Government and Finance study the need for legislation to recoup law-enforcement investigative costs from convicted criminals.

    Whereas, The Legislature of the State of Florida enacted a law in 1987, Florida statute 938.27, previously 939.01, entitled “Judgment for Costs on Conviction,” which permits courts to impose upon convicted criminals the investigative costs incurred by law- enforcement agencies in their prosecution; and

    Whereas, The effect of Florida’s “Judgment for Costs on Conviction” statute has been to lessen the tax payer burden by shifting the financial burden of investigative expenses onto the criminals, in addition to any other fines or court costs that may otherwise be imposed; therefore, be it

    Resolved by the Legislature of West Virginia:

    That the Joint Committee on Government and Finance is hereby requested to study the need for legislation to recoup law- enforcement investigative costs from convicted criminals; and, be it

    Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 2013, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it

    Further Resolved, That the expenses necessary to conduct this study, to prepare a report and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
