A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §17-3-11, relating to
expenditure of funds from the 2009 economic stimulus plan for
road repair and construction; and requiring funds to be first
spent for repair of the West Virginia Turnpike before any
other expenditures in the third congressional district.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §17-3-11, to read as
follows:
ARTICLE 3. STATE ROAD FUND.
§17-3-11. Expenditure of 2009 Economic Stimulus Funds.
Notwithstanding any other provision of law to the contrary,
and subject to compliance with federal rules and regulations
relating to the use of funds allocated to states for the repair and construction of highways, the Commissioner of Highways shall expend
funds, allocated from the federal 2009 Economic Stimulus Program to
the State of West Virginia for highway repair and construction,
first for repairs to the West Virginia Turnpike, before expending
any other such funds in the 3rd Congressional District of the state.
NOTE: The purpose of this bill is to require expenditure of
funds from the 2009 Economic Stimulus Plan for road repair and
construction to be first spent for repair of the West Virginia
Turnpike before expending any other sums in the 3rd Congressional
District.
