A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §29A-3B-13, relating to providing that at any point after a county board of education provides written notice to the state board that it is considering or in the process of closing or consolidating a school or schools, any revision or supplementation to certain rules is not applicable to the school closing or consolidation project described in the county board’s notification to the state board.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §29A-3B-13, to read as follows:

ARTICLE 3B. STATE BOARD OF EDUCATION RULEMAKING.


§29A-3B-13. Application of certain rules to certain projects.

Notwithstanding any provision of this code to the contrary, at any point after a county board of education provides written notice to the state board that it is considering or in the process of closing or consolidating a school or schools, any revision or supplementation to legislative rule 126 C. S. R. §172, West Virginia Board of Education Policy 6200, Handbook on Planning School Facilities; legislative rule 126 C. S. R. §176, West Virginia Board of Education Policy 6204, School Closings or Consolidations, or any other rule the board elects to promulgate, adopt, amend or repeal relating to school construction, school consolidation or school closing, whether or not the rule is procedural, interpretive or legislative, shall not be applicable to the school closing or consolidation project described in the county board’s notification to the state board.

 

NOTE: The purpose of this bill is to provide that at any point after a county board of education provides written notice to the state board that it is considering or in the process of closing or consolidating a school or schools, any revision or supplementation to certain rules is not applicable to the school closing or consolidation project described in the county board's notification to the state board.
