A BILL to amend and reenact §5A-3-52 of the Code of West Virginia, 1931, as amended, relating to special funds for travel management; creating the Aviation Fund and the Fleet Management Office Fund; providing the moneys in these funds do not expire; providing the funds are to be used for aviation and fleet management purposes; and requiring costs and expenses will be borne by the agency or department using the aviation or fleet services.

Be it enacted by the Legislature of West Virginia:

    That §5A-3-52 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:

ARTICLE 3. PURCHASING DIVISION.

§5A-3-52. Special funds for travel management created.

    There is hereby created in the State Treasury two special revenue funds to be known as the “Aviation Fund” and the “Fleet Management Office Fund”. These funds may be given appropriations as determined by the Governor and the Legislature but shall operate as special revenue funds. All deposits and payments into these funds do not expire nor shall they be transferred into the General Revenue Fund. All deposits in the funds shall remain in the Aviation Fund and the Fleet Management Office Fund and be available for expenditure in succeeding fiscal years. All costs and expenses incurred pursuant to this section, including administrative, shall be paid from those funds. All allocations of costs and charges for operating, repairing and servicing aircraft made against any institution, agency or department shall be paid into the Aviation Fund by that department or agency. All allocations of costs and charges for operating, repairing and servicing motor vehicles made against any institution, agency or department shall be paid into the Fleet Management Office Fund by that department or agency. All moneys paid or transferred into these special revenue funds are appropriated for the purpose of this section and shall be paid out as the secretary may designate. The moneys to be transferred include all appropriations for acquisition, maintenance, repair and operation of motor vehicles and aircraft and for personnel. All deposits currently in the special fund for travel management derived from special revenue from aviation fees shall be transferred into the Aviation Fund and all funds in the special fund for travel management that was derived from the monthly fee for vehicles shall be transferred into the Fleet Management Office Fund.



    NOTE: The purpose of this bill is to rewrite the current section on funds for travel management. The bill creates the Aviation Fund and the Fleet Management Office Fund. The bill provides that the moneys in these funds do not expire and are to be used for aviation and fleet management purposes, respectively. The bill requires costs and expenses to be borne by the agency or department using the aviation and fleet services.
