A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §17B-3-14, relating
to motor vehicle driver's license; cancellation, suspension or
revocation of licenses; and establishing a driver's license
restoration program.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §17B-3-14, to read as
follows:
ARTICLE 3. CANCELLATION, SUSPENSION OR REVOCATION OF LICENSES.
§17B-3-14. Authority of division to establish a license
restoration program.
(a) The division is hereby required to establish a driver's
license restoration program within the Driver Services Section of the Division of Motor Vehicles.
(b) The driver's license restoration program is responsible
for providing information and other educational services intended
to assist persons in the reinstatement of their driving privileges
after their driver's license have been suspended or revoked by the
division.
(c) The Commissioner of the Division of Motor Vehicles shall:
(1) Develop information and educational materials necessary to
support the driver's license restoration program;
(2) Process reports showing the specific driving history of
each program participant so that individual counseling assistance
can be provided relative to the restoration requirements for each
license;
(3) Make these program services available at all county
regional offices of the Division of Motor Vehicles and at all Day
Report centers operated in conjunction with Community Corrections
Programs throughout the state:
Provided, That if there is no
division regional office or a Day Report center in any county, the
commissioner shall provide for the delivery of these services at
any other public meeting place located in the county; and
(4) Ensure that the treatment and rehabilitation programs
required for the reinstatement of driver's license revoked due to
driving under the influence be made available to those persons at
the Day Report Centers for Community Correction Programs and not exclusively through contracts with local or regional community
mental health programs as required in other provisions of this
code.
NOTE: The purpose of this bill is to
establish a driver's
license restoration program
for persons whose motor vehicle
driver's license has been cancelled, suspended or revoked.
