A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §19-1A-6, relating to closure and sale of Clements State Tree Nursery.

Be it enacted by the Legislature of West Virginia:

            That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §19-1A-6, to read as follows:

ARTICLE 1A. DIVISION OF FORESTRY.

§19-1A-6. Closure and sale of Clements State Tree Nursery.

            The director shall phase out use of the Clements State Tree Nursery and cease operations at the facility on or before July 1, 2018. At that time the Clements State Tree Nursery shall be sold for fair market value and proceeds from the sale shall be deposited into the State General Revenue Fund.

            NOTE: The purpose of this bill is to require the phasing out of operations at the Division of Forestry's Clements State Nursery. After cessation of operations on or before July 1, 2018, the facility is to be sold for fair market value and the proceeds deposited in the State General Revenue Fund.
